Say for the sake of argument that you, like any other guy, rub a couple out to some Youtube videos of a spandex-clad female contortionist.

Upon doing a little cyber-stalking, you happen to learn that she is in fact only 17.

Does that make you retroactively in possession of child pornography, or does it only count if you go back and watch them again?

It depends, if she looks like she's 17, and that was part of the appeal to you, then yeah, it's wrong. If you honestly thought she was of legal age and it was merely her physical attributes that you found appealing then I don't think it constitues anything more inherently immoral than looking at any other form of "adult" entertainment.

Screw the whole porn issue. Lets say your 15 year old step son comes and spends a Christmas break with your wife and while he is there does a little text sex and photo trading with his 14 year old goilfriend. Now you have child porn on your phone thanks to the dumbass stepkid and lets pretend "big Borother" or whomever turns you in. Yes and fortunately she was using a camera that either wasn't compatible or was set on hi-res and her picks did not come out. His picks were just face and upper body shots so thank god i don't have his 15 yr old wang for a screen saver. Needless to say cell phone priveledge was immediately and irrevocably denied!
