The problem is a lack of paper trail, that could be used to secure possible criminal charges. Undoubtedly one or more of the top people gave the word that this should be done but what can be surmised, and what can be proved, are widely divergent ideas.

It all probably starts with some VP saying that to an underling that pay-outs have to be reduced, "... and I don't care how. Just do it!"
