I caught this on another forum. that dealer is FUCKED.
last I looked, a legally binding contract is between two parties, in this case, the buyer, and the dealer selling what the buyer purchased. this contract binds both parties to honor their part of the deal. as soon as the dealer is taken to court, I can pretty much already forsee the outcome. if I were this guy, I'd take em to court just on principle and to hell with the car. then once I won it, do a WICKED burnout leaving the dealership. |

I read through 5 pages...no mention of which dealership, though it is in Los Angeles.
I'd of went there and handed them the deposit. lol

Naw dealer aint fucked on this one, he will just play hardball and out lawyer the other guy, maybe some bad press but not enough to hurt bussiness for more than a month if that is even signifigant. The guys best hope is to park a car out front (on a public street or parking lot) and write on his car that the dealership screwed him, that might actually hurt busines.
There was some dude who went through this with a hyundai dealership (hasnt gotten his car yet, nor will he probably ever) and another one over a BMW (that case BMW of america stepped in after numerous calls and a lawsuit, the guy got the car but not for the 60k ebay price). I just dont see this guy winning this car unless he is a lawyer and has the time and money to fight it in court in the jurisdiction where the dealership is located.

Was reading that the dealer had a reserve on there at what they wanted, then removed the reserve when the car didnt get the bids they were expecting, the guy won. If he goes to trial (and can afford the eventual legal costs) and can prove that the dealership knowingly removed the reserve price he has a chance at winning, that is if he can afford the legal costs.
