Angry Federal court upholds NY MC checkpoints

It is complete discrimination and profiling at it's best.

ALBANY, N.Y. — A federal judge has rejected motorcyclists' claims their constitutional rights were violated by New York State Police highway checkpoints that stopped thousands of riders and ticketed many.

Judge Gary Sharpe concludes the main focus of the 2008 statewide initiative by troopers, timed to coincide with rallies drawing crowds of riders, was safety.

Sharpe says that distinguishes them from "a general interest in crime control" that could have amounted to unconstitutional seizures when there's no "individualized suspicion of wrongdoing."

Four motorcyclists sued troopers claiming safety was a mere pretext in looking for criminals.


According to Sharpe, 5,342 vehicles passed through 17 checkpoints in 2008.

Authorities inspected 2,278 and issued 1,064 tickets, including 365 for helmet violations, 99 for other safety violations, 600 for non-safety violations, and made four criminal arrests.

I wear a half DOT around here. but on the road trips, I'm wearing a full face modular... they wouldn't stop me then.

But it's BS. I'm glad in Michigan they have ALL road block down as unconstitutional.

yep I was going to go to Americade one year and they told me on the phone to expect to be stopped and ticketed if my pipes were anything but stock. Went somewhere else.

Well I have 50 state legal Harley slip ons... but they aren't stock... wonder what they would say.

They'll give you a ticket to bust your balls because you're from out of state and bank on the odds being that you won't tavel all the way back to NY to contest it.
