Was reading that the dealer had a reserve on there at what they wanted, then removed the reserve when the car didnt get the bids they were expecting, the guy won. If he goes to trial (and can afford the eventual legal costs) and can prove that the dealership knowingly removed the reserve price he has a chance at winning, that is if he can afford the legal costs.

The disclaimer says it's a binding contract to buy the car. It doesn't say it's a binding contract for the seller to sell the car. I learned in business law class that a landlord can have a person sign the lease, which binds that person to renting the place, but if the landlord doesn't sign, he's not bound to renting the place out to that person. Now, that being said, if the landlord lets the person take possession of the place, it's considered that he also accepted the lease, but until they take possession, the landlord isn't held to renting to that person. I imagine the same thing goes here, but would have to read eBay's rules.
Regardless, the dealership won't honor it and they'll just accept the bad feedback and close their seller account. I bet someone is getting an ass chewing, though. |

The majority of contract law is offer and acceptance, written or implied by action. I would wager they did not want the bad publicity from a lawsuit and whatever consequences that they would run with E Bay's attornies...

He got a good deal, but I doubt that challengers are are in such a demand that it would sell very quick.
